WAIVER AND RELEASE

            For valuable consideration, including but not limited to the acceptance of my application for the Fabulous Fourth Metric Century Tour ("The Tour"), the receipt and adequacy of which is hereby acknowledged, I hereby waive, release and forever discharge NationsBank, its successors, assigns, affiliates, subsidiaries, and agents and employees, all other promoters, organizers, officials, and any involved municipalities or other entities (and their respective agents and employees) (collectively the "Parties") from any and all claims for damages, demands, liabilities, losses and expenses of whatsoever kind or whatsoever nature (including but not limited to, any claims of attorneys' fees) for death, personal injury, and/or property damage which I may have or which may hereafter accrue to me, as a result of my participation in The Tour. This release is intended to discharge the above named Parties from and against any and all liability arising out of or connected in any way with my participation in The Tour even though that liability may arise out of my negligence or carelessness on the part of any such Party named above. It is further understood and agreed that this release is to be binding on my heirs or assigns. 

            I have carefully read this release and understand the contents hereof and agree to each term and have executed it as of my own free act and deed.
